2025 BUSINESS RESCUE PRACTITIONER EXEMPTION APPLICATION

1. PROTECTION OF PERSONAL INFORMATION ACT

Collection and Lawful Processing of Personal Information:

SAICA respects your privacy and recognises the importance of protecting your privacy in respect of your personal information. By completing and submitting this exemption application, SAICA will collect and/or verify, and process your personal information in the conducting and conclusion of the compliance and/or monitoring processes.

What Personal Information we collect and process: SAICA will collect and/or verify, and process your personal information, including but not limited to your full name, identity number, SAICA membership number and contact details.

Processing of Personal Information:The personal information SAICA collects and/or verifies and processes will only be processed for the purpose it is collected for.

2. GENERAL INFORMATION

2.1. Please confirm your personal details (Note: Please update your personal information under the profile section of the Member portal)

3. BUSINESS RESCUE PRACTITIONER CPD EXEMPTION REQUIREMENTS

3.1. In terms of the Companies and Intellectual Property Commission (CIPC) Business Rescue Continuing Professional Development (CPD) Policy, registered Business Rescue Practitioners may apply for exemption from the CPD requirements only under exceptional circumstances.

3.2. To be considered for exemption, please take note of the following conditions:

  • You must not be professionally active. This means that you may not perform any work related to business rescue, whether paid or unpaid, during the exemption period.
  • The exemption must relate to an extended period of inactivity. Short-term breaks or temporary leave do not qualify.
  • Exemption applications are assessed on a case-by-case basis.

3.3. If you meet the above criteria, you are required to submit a formal application for exemption each year, with supporting information detailing your circumstances and confirming that you will not be professionally active during the period in question. Please note:

  • Exemptions are valid for one calendar year only. You must apply for exemption annually if the circumstances continue to apply.
  • Once the circumstances under which the exemption was granted no longer apply, you must immediately inform your professional body.

3.4. Example of a valid exemption scenario

  • A Business Rescue Practitioner taking extended family responsibility leave for the entire year, and who will not be performing any business rescue-related work, may apply for exemption.
  • Important: Exemption is not automatic. A new application must be submitted each year, and all applications are subject to approval.

4. 2025 BUSINESS RESCUE PRACTITIONER ANNUAL EXEMPTION APPLICATION

4.1. By completing and submitting this Business Rescue Practitioner Annual Exemption Application, I, as the deponent, acknowledge that the facts contained therein and the exemption application request fall within my personal knowledge and belief, are true and correct.

Note: Active licensed BRP is defined as a Business Rescue Practitioner that has accepted a business rescue appointment during the period 1 January 2025 – 31 December 2025 and Inactive licensed BRP is defined as a Business Rescue Practitioner that has not accepted a business rescue appointment for 1 January 2025 – 31 December 2025.
